A&A Plastering, LLC will perform the services outlined in the bid proposal according to industry standards. This proposal covers only the work described in the bid. Any modifications, additions, or deletions must be agreed upon in writing and may result in an adjustment to the contract price.
By accepting this bid, the client agrees to the scope, terms, and conditions set forth herein. Acceptance of the proposal can be indicated through signed documentation, email confirmation, or verbal acceptance. A&A Plastering, LLC reserves the right to withdraw or modify the proposal if it is not accepted within 30 days.
Payment terms will be specified in the bid proposal. Typically, a deposit is required upon signing, with progress payments due at agreed-upon stages of the project. Full payment is due upon completion of the work. In the event of non-payment, A&A Plastering, LLC reserves the right to cease work until payment is received. Any late payments may incur a fee of [X]% per month.
Any changes to the scope of work requested by the client, such as additional services or materials, must be agreed upon in writing as a Change Order. Change Orders may result in adjustments to the project timeline and price. All Change Orders must be signed by both parties before additional work commences.
A&A Plastering, LLC will make every effort to adhere to the schedule provided. However, factors beyond the company’s control, such as weather, supply delays, or unforeseen job site conditions, may cause delays. A&A Plastering, LLC is not liable for delays due to such causes but will communicate any anticipated changes to the timeline with the client.
A&A Plastering, LLC uses high-quality materials suited to the specific requirements of each job. A&A Plastering, LLC warrants its labor and installation for a period of [X] years, covering only defects in workmanship. Material warranties are provided by the manufacturers and may vary by product. This warranty does not cover natural wear and tear, damage caused by external factors, or unauthorized alterations to the work.
The client is responsible for providing safe and accessible job site conditions. A&A Plastering, LLC shall not be liable for any damage caused to landscaping, underground utilities, or other items that may be impacted by the work. The client agrees to make known the location of any hidden utilities, piping, or wiring prior to the commencement of work.
A&A Plastering, LLC is fully insured and will exercise reasonable care in the performance of its work. However, the company is not responsible for any pre-existing structural damage or conditions that may become apparent during the project. Any damage caused by A&A Plastering, LLC’s crew will be assessed and resolved by A&A Plastering, LLC in consultation with the client.
Either party may terminate this agreement if the other party breaches any material term of the contract. In the event of termination by the client, payment for all completed work and materials on-site is due immediately. If A&A Plastering, LLC terminates the agreement, any unearned deposit will be returned, and the project will be left in a safe and acceptable condition.
A&A Plastering, LLC’s liability is limited to the total value of the contract. Under no circumstances shall A&A Plastering, LLC be liable for indirect, incidental, or consequential damages, including loss of use or loss of revenue, even if advised of such possibilities.
This agreement shall be governed by and construed in accordance with the laws of the state of Kansas (or Missouri, depending on the project location). Any disputes arising from this agreement will be resolved in the appropriate jurisdiction.
This document, along with any signed Change Orders, constitutes the entire agreement between A&A Plastering, LLC and the client. No other verbal or written agreements are considered valid unless included in a signed amendment to this agreement.
By signing below, the client agrees to the terms and conditions listed above and authorizes A&A Plastering, LLC to proceed with the work as described in the bid proposal.
